About PlantBetter
PlantBetter helps users identify plants, understand care needs, plan what to grow, organize plant collections, receive reminders, and learn about possible diseases, pests, and other plant-related problems. Photo-based and AI-powered features may provide identification, recommendations, and care guidance.
Eligibility
You may use PlantBetter only if you are legally permitted to enter into an agreement under applicable law. If you use PlantBetter for another person or organization, you confirm that you have authority to accept these Terms for them.
Using PlantBetter
You agree to use PlantBetter only for lawful purposes. You must not:
- Violate applicable laws or regulations.
- Interfere with, damage, disrupt, or gain unauthorized access to the service.
- Reverse engineer, copy, reproduce, or misuse PlantBetter except where permitted by law.
- Upload content that infringes another person’s rights.
- Use the service for fraudulent, abusive, or harmful purposes.
Plant Identification and Care Guidance
Plant identification, disease analysis, treatment suggestions, plant recommendations, and care guidance are informational. Results vary with image quality, plant condition, environment, location, and other circumstances. Use reasonable judgment when making decisions based on this information.
Photos and User Content
You are responsible for ensuring you have the right to upload content you submit. By submitting content for a PlantBetter feature, you authorize us to process it as needed to provide the requested service.
My Plants and Reminders
PlantBetter may let users save plants, organize collections, and receive reminders for watering, fertilizing, pruning, repotting, and seasonal care. Timing and recommendations may need adjustment for each plant and environment.
Subscriptions
PlantBetter may offer subscriptions. Pricing, billing periods, renewal information, and purchase details will be shown before purchase. App Store purchases may also be governed by Apple’s terms and policies.
Environmental Impact
A portion of revenue from every PlantBetter subscription supports initiatives focused on tree planting and forest restoration.
Intellectual Property
The PlantBetter name, branding, software, interface, graphics, text, features, designs, and other content are protected by applicable intellectual-property laws. Unless expressly permitted, you may not copy, distribute, reproduce, modify, sell, license, or commercially exploit them.
Third-Party Services
PlantBetter may link to or integrate with third-party services, including the Apple App Store. Those services operate under their own terms and privacy practices.
Service Availability
We work to provide a reliable experience but do not guarantee uninterrupted or error-free operation. Features may be modified, improved, suspended, or discontinued.
Disclaimer and Limitation of Liability
We do not guarantee that every identification, diagnosis, recommendation, or care suggestion will be accurate or appropriate in every situation. To the maximum extent permitted by law, PlantBetter and its operators will not be liable for indirect, incidental, special, consequential, or similar damages. Nothing excludes liability that cannot legally be excluded.
Changes to These Terms
We may update these Terms. Updated Terms will be posted here with a revised effective date. Continued use after they take effect means you accept them.
Dispute Resolution and Class Action Waiver
Please read this section carefully — it affects your legal rights. To the fullest extent permitted by law, you and PlantBetter agree that any dispute, claim, or controversy arising out of or relating to PlantBetter, these Terms, or your use of the service, including any claim that arose before this section took effect, will be resolved only as described below and not in a courtroom.
Informal resolution first. Before either party begins arbitration, the party raising the dispute agrees to notify us through our Support page, describe the problem in reasonable detail, and give us 30 days to resolve it informally.
Binding arbitration. Any dispute not resolved informally will be finally settled by binding arbitration under the arbitration rules of the American Arbitration Association then in effect, as modified by this section. The arbitration will be conducted by a single neutral arbitrator, on a written, telephonic, or video basis unless the arbitrator finds an in-person hearing necessary. The arbitrator has the authority to award any relief a court could award, and the arbitrator’s decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Individual basis only — no class actions. Arbitration must be conducted on an individual basis only. You and PlantBetter each agree that: (a) neither party will bring, join, or participate in a class action, collective action, consolidated action, private attorney general action, or any other representative proceeding of any kind regarding a dispute; (b) the arbitrator may not consolidate, join, or otherwise combine the claims of more than one person or entity, and may not otherwise preside over any class, collective, consolidated, or representative proceeding; and (c) the arbitrator may award relief only in favor of the individual party seeking it, and only to the extent necessary to provide relief warranted by that party’s individual claim.
Small claims and jury waiver. Either party may bring an individual dispute in a small-claims court in the county where you reside, if the claim qualifies and the court has jurisdiction, and that proceeding is not subject to arbitration. To the extent permitted by law, you and PlantBetter each waive any right to a trial by jury in any action arising out of or relating to PlantBetter or these Terms.
Your right to opt out. You may decline this section by notifying us through our Support page within 30 days of first accepting these Terms. If you do, this section will not apply to you, and the rest of these Terms will remain in full effect.
Governing law and severability. Except where preempted by the Federal Arbitration Act or other federal law, these Terms are governed by the laws of the State of California without regard to conflict-of-law rules, and venue for any court proceeding permitted by this section lies in the state and federal courts located in Los Angeles County, California. This section survives termination of these Terms and of your use of PlantBetter. If any part of this section is found unenforceable, that part will be modified to the minimum extent needed to make it enforceable, or severed if it cannot be modified, and the remainder will be enforced.
